1. Pursuant to the provisions of reference (a) Subject, hereinafter:
referred to as Petitioner, filed enclosure {1) with this Board
requesting, in effect, that the applicable naval record be corrected
to establish entitlement to a zone “A” Selective Reenlistment Bonus
(SRB).
2. The Board, consisting of Mr. Zsalman, Mr. George, and
Mr. Ruskin, reviewed Petitioner’s allegations of error and injustice
on 4 March 2014 and, pursuant to its regulations, determined that the
corrective action indicated below should be taken on the available
evidence of record. Documentary material considered by the Board
consisted of the enclosures, maval records, and applicable statutes,
regulations and policies.
3. The Board, having reviewed all the facts of record pertaining to
Petitioner's allegations of error and injustice, finds as follows:
a. Before applying to this Board, Petitioner exhausted all
administrative remedies available under existing law and regulations
within the Department of the Navy.
b. In correspondence attached as enclosure (2), the office
having cognizance over the subject matter addressed in Petitioner’s
application has commented to the effect that the request has merit and
warrants favorable action. ”
CONCLUSION
Upon review and consideration of all the evidence of record, and
especially in light of the contents of enclosure (2), the Board finds
the existence of an injustice warranting the following partial
corrective action:

a. Records show that the Petitioner enlisted into the Navy on @

nm eniisted bonus of $32,600.
b. The Petitioner was discharged on QQ for Erroneous
Entry (failing to disclose important information regarding a legai
proceeding during in-processing paperwork). He incurred a debt of
$21,267.08 (Enlistment bonus) as he was unable to complete his term of
enlistment in accordance with DODFMR volume 7A, chapter 9, paragraph
090107.
¢. Petitioner's civilian case for a violation that took place on
- prior to his initial entry into the Navy - was heard at

d. Petitioner was authorized to reenter active service on Ai
RECOMMENDATION:
That Petitioner’s naval record be corrected, where appropriate, to
show that:
a. Paragraph 8b (Remarks) of the DD Form 4/1 (Oct 2007) executed
on or about _ is modified to read “REENLISTED FOR THE
FOLLOWING INCENTIVE: ZONE A SRB AWARD LEVEL 2.5." Note: all other
remarks remain the same.
b. This change will entitle the member to a zone “A” SRB with an
award level of 2.5 ($60,000 dollar award ceiling) for the SB/5352
rate/NEC.
c. That part of the Petitioner's request for corrective action
that exceeds the foregoing is denied.
d. A copy of this Report of Proceedings will be filed in
Petitioner's naval record.
4. It is certified that quorum was present at the Board’s review and
deliberations, and that the foregoing is a true and complete record of
the Board's proceedings in the above entitled matter.

RECOMMENDATION: That Petitioner’s naval record be corrected, where appropriate, to show that: a. Petitioner's command submitted a request via OPINS prior to 16 March 2009 seeking authorization for Petitioner to reenlist on 20 April 2009 for an SRB.
